Explanation of a Proposed Activity in a Floodplain

To:  All interested Agencies, Groups, and Individuals
 
This is to give notice that the U.S. Department of Housing and Urban Development (HUD) under CFR Part 50 has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. The activity is funded under Section 223(f) of the National Housing Act. 

The project sponsor is assigning the HAP contract from the current owner to the new owner and paying off the existing 223(f) loan for the property with a construction loan at closing. The project will include significant rehabilitation of Pablo Hamlet, a 104-unit senior community located on 6.01 acres of addressed at 1600 Shetter Avenue, Jacksonville Beach, Florida 32250. The subject property was developed as a HUD Project Based Section 8 apartment complex for the elderly in 1980. The proposed improvements include renovations to the existing two (2) three-story residential buildings and new construction of a 20,700 square foot mixed-use building consisting of 50 residential units and a community center. The project site currently features paved surface parking spaces, courtyard, and a walking trail. Proposed site improvements include two smaller courtyards, additional parking, and a large detention pond. Rehabilitation of the existing buildings will include both interior and exterior upgrades.

Approximately 2.76 acres of the property is impacted by the 100-year floodplain, while an additional 2.99 acres is within the 500-year floodplain. Development plans include permanent impacts to 0.47 acres of floodplain through the addition of fill material to ensure the new building is constructed at least two feet above the base flood elevation. Both existing buildings are located outside of the 100-year floodplain and above the base elevation of 5 feet. A request has been submitted to FEMA for a Conditional Letter of Map Revision based on fill (CLOMR-F) for the proposed building. Wetlands have been identified onsite but will not be impacted by the proposed development.

The potential for historic resources is unlikely based on correspondence with the Florida State Historic Preservation Officer. No suitable habitat for federal or state-listed species will be impacted by the development. Due to the private ownership and lack of unique natural features, there is no expected public interest for recreational, scientific, or educational purposes.

HUD has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values:

   1) No Action: HUD does not insure the proposed development.  This alternative was not selected since it fails to address a need for affordable senior rental housing within the target area.
   2) Select a different location: Developing the project at the subject property provides a significant advantage as the site is currently developed and project plans include significant rehabilitation to existing structures. Developing a new site would involve the acquisition of new land and construction of new buildings, utilities, and infrastructure. Siting the project at an alternative location is not economically or logistically feasible, and alternative sites were rejected as potential locations for the project.
   3) Modify the project to avoid or minimize impacts to the floodplain: Over 95% of the subject property is located within the 100 and 500-year floodplain. The only undeveloped area outside of the 100-year floodplain consists of jurisdictional wetlands. The new mixed-use building will be constructed between the two existing buildings which is currently a courtyard with concrete sidewalks, gardens, and parking. Based on the significant land area impacted by both floodplain and wetlands, avoidance of additional floodplain impacts is not practical.

Insure the development as proposed: Although this alternative would result in modification to the floodplain, the need for affordable senior housing in Jacksonville Beach necessitates the significant rehabilitation and expansion of the Pablo Hamlet complex. Mitigation measures incorporated into the project design include a new stormwater collection system to minimize impacts to downstream properties, flood insurance on the new building until it is effectively removed from the floodplain, and a deed restriction preventing future development of the onsite wetlands. A request for a Conditional Letter of Map Revision (CLOMR) has been submitted to FEMA to remove 0.47 acres from the floodplain once construction is complete. Additionally, all state and local water quality protection procedures will be included into the construction plans.

HUD has reevaluated the alternatives to building in a floodplain and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.
